WELLIFIZE PRIVACY POLICY

This Privacy Policy (the “Policy”) explains how ARCHETYPE Wellness LLC (“us,” “our,” or “we”) collects, uses, and discloses information that we collect from and about you through our website www.wellifize.com (the “Website”), the WELLIFIZE mobile application (the “App”), and any other online services that we operate and that include a link to this Policy (collectively with the Website and App, the “Services”). Except as otherwise expressly provided in this Policy, this Policy does not apply to information that we collect offline or through other channels that are not part of the Services.
Please note that while we collect and process information related to your health, we are not a covered entity subject to HIPAA. HIPAA’s requirements do not apply to the health information we collect and process through the Services.
The Information We Collect and How We Collect It
When you use or access the Services, we may collect information: (i) that you provide to us directly through the Services, (ii) that we collect automatically when you use the Services, (iii) that we receive from internet-connected smart home, wearable, and other devices connected to the App; and (iv) that we receive from third-party applications that you choose to integrate with our App.
Information We Collect Directly from You
When you use or access the Services, we may collect information that you choose to provide directly, such as the following:
Profile and authentication information, such as your name, profile photo, email address, username, and password.
Demographic information such as your date of birth, biological sex, and race or ethnicity.
Information about your health and fitness goals such as your selected health plans and programs, and your desired bodyweight, sleep, and activity and exercise levels; and information about your progress toward those goals.
Information about your sleep preferences, nutritional preferences, and dietary restrictions.
Information included in communications that you transmit through the “Chats” feature in the App.
Photographic and video images collected through Wellness Scans that you perform through the App using your mobile device’s camera, such as facial scans, body mapping scans, and other scans, and the biomarkers and other health and wellness data that the Services derive from those images;
Health-related information collected through lab tests or other measurement methods that you manually input into the Services, such as your height, weight, biomarkers, and other body measurements.
Self-reported health and fitness activity information that you manually enter into the Services, such as your steps; sleep and wake times and sleep duration; exercise information including exercise type, time of activity, activity duration, and activity intensity; heart rate; and heart rate variability.
Information about your diet and dietary habits that you enter into the App, including meal plans and recipes that you search for and select, items you add to your Shopping List, and your meals and their associated nutritional content.
Information that you provide in connection with your use and occupancy of your residential Unit and building, including information about your lease and information that you submit through repair requests and requests to book community amenities.
Payment information that you provide when you pay rent for your Unit or make purchases through the App, such as payment card numbers, expiration dates, associated security codes, and billing addresses.
Any other information you choose to submit when you contact us through the Website or App, including in submissions that you make through forms we make available through the Services. Information We Collect Automatically from Your Use of the Services We also may collect certain other information automatically when you use or access the Services, such as the following:
Browser and device Information. Information about your computer or mobile device, such as IP and MAC address, operating system, browser type, operating system, and information about your mobile network and internet connection.
Usage and clickstream information. Information about your use of the Services, such as pages visited and features used; referring URLs; video, audio and other content you consume through the App; and time spent using the Services and features thereof.
Transactional Information. Information about purchases you make through the Services, such as product or service descriptions, price, subscription details, and times and dates of transactions.
Communications Information. We may record the contents of communications you have through the Services, such as when you use the “Chats” feature in the App to communicate with other users, coaches, or chatbots.
Information Collected in Connection with Analytics Technology. We may use various technologies to learn more about how you use the Services, such as Google Analytics. For more information on Google Analytics, including how Google Analytics collects, uses, and discloses information, refer to the following page: www.google.com/policies/privacy/partners/.
Location Information. When you use the Services, we may automatically collect information about your location, including your approximate geographic location as indicated by your device’s IP address, and, if you allow your mobile device to share information about your location with the App, your precise geolocation. The technologies we use for this automatic data collection may include:
Cookies (or mobile cookies). We use cookies and similar technologies in connection with the Services to store and honor your preferences and settings, enable you to sign-in, provide interest-based advertising, combat fraud, analyze the performance of the Services, and to fulfill other legitimate business purposes. A cookie is a small file placed on the hard drive of your computer or your mobile device to store data that can be recalled by a web server in the domain that placed the cookie. This data often consists of a string of numbers and letters that uniquely identifies your computer, but it can contain other information as well. Some cookies on our Website are placed by third parties, such as companies we hire to provide services on our behalf.
Flash Cookies. Certain features of the Services may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Services. Flash cookies are not managed by the same browser settings as are used for browser cookies.
Web Beacons. Pages of our Services and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that enable Us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
Software Development Kits (or SDKs). SDKs are pieces of code provided by our service providers (e.g., development and analytics providers) that are incorporated into our App to collect and analyze certain device and user data. Information We Receive from Devices You Connect to the App
Smart Home Devices. You can use the App to connect to certain internet-connected smart home devices in your Unit, such as such as radar sensors, other types of sensors and monitors in your Unit, and smart appliances such as fans, thermostats, lights, and speakers. When those devices are connected to the App, we will receive information collected through those devices, which may include information about your and others’ physical movements, habits, and sleep patterns within your Unit, and information about the use of those devices, including times and durations of use and other device-specific information such as fan speed, temperature, brightness of lights, speaker volume, and audio content played.
Wearable and other connected health and fitness devices. If you connect a wearable device, such as a smartwatch or heart rate monitor, or another internet-connected health and fitness device, such as a smart scale, to the App, we will receive information collected through that device, which may include information about your health, biomarkers, and exercise activity.
Smart Fitness and Exercise Equipment. If you connect internet-connected smart fitness or exercise equipment in your Unit or building to the App, we will collect information about your use of that equipment, which may include time and duration of use and other information collected through the equipment, which may include health information such as your heart rate. Information We Receive from Third-Party Applications You Choose to Integrate with the App We will also receive information from third-party applications that you choose to integrate with the App. Depending on the third-party application and your integration selections, the information we receive from such third party applications may include your fitness information, such as exercise type, time, and duration and other activity-related information, as well as health and wellness information such as information about your sleep, nutrition, and biomarkers such as heart rate and heart rate variability.
How We Use Your Information
We use information that we collect about you or that you provide to Us through the Services for the following purposes:
Providing, maintaining, personalizing, and protecting, the Services, including by delivering features and functionality that you request and use and generating and delivering related analytics, visualizations, reports, and recommendations.
Providing aspects of the Services for which you consent to our use of the information, including for our processing of your health information for the purpose of delivering and enabling the features and functionality of the Services and generating and delivering analytics, visualizations, and other reports and recommendations to help you enhance your health and wellness.
Controlling and enhancing the operation of smart home devices in your Unit that you connect to the Services, such as by turning climate control systems, lights, and speakers on or off based on the Services’ analysis of your use of those devices and other information collected through the Services.
Processing payments for your rent and other purchases you make through the Services.
Developing and improving the Services and developing new products and services.
Evaluating, debugging, identifying and repairing errors, and effectuating similar functional enhancements.
Understanding how you and other users use our Services, performing analytics, analyzing and reporting on usage and performance of the Services, and determining what features and functionality may interest you and other users.
Communicating with you and others, including responding to your requests and providing promotional information.
Offering, marketing, or advertising products, programs, and services from us, our affiliates, business partners, and select third parties to you, including through targeted advertising.
Storing information about your preferences, recognizing you when you use the Services, and customizing your experience.
Creating aggregate or de-identified information.
For our own legal and safety purposes, such as maintaining the safety, security, and integrity of our Services, other technology assets, services, and our organization; preserving or enforcing our legal rights and property; protecting our users, our employees, and others; and complying with industry standards.
Protecting against malicious, deceptive, fraudulent, or illegal activity, and participating in any prosecution or enforcement of laws or agreements meant to prevent or punish such activity.
Enforcing our policies, terms of use, contracts, or other legal rights.
Evaluating or participating in an actual or potential merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, including as part of bankruptcy, liquidation, or similar proceedings.
Such other purposes as you may expressly authorize when we collect the information or when we otherwise ask for your permission.
We may also aggregate or de-identify your information by removing any details that identify, or that could reasonably be used to identify, you personally. The resulting aggregated or de-identified information, which we will maintain and use without attempting to re-identify or otherwise link it to you personally, will not be subject to this Policy and may be used and disclosed for any lawful purpose.
How We Disclose Your Information
We may disclose information we collect about you:
To our contractors, service providers, payment processors, and other third parties we use to support our organization, which may include support of any of the data uses described above.
To other users with whom you communicate through the Services, such as other community members with whom you communicate through the “Chat” feature in the App.
To health coaches with whom you interact through the Services.
To our business partners, or such as partners involved in discount offers, product promotions, and co-branded offerings that we make available to you and that you choose to take advantage of when you use the Services.
To our current and future parents, affiliates, subsidiaries and other companies under common ownership or control with us.
To comply with applicable law, other legal requirements, and applicable industry and self-regulatory standards.
To enforce our policies, terms of use, contracts, or other legal rights.
To investigate or prevent unlawful activities or misuse of the Services.
To protect against malicious, deceptive, fraudulent, or illegal activity, and participating in any prosecution or enforcement of laws or agreements meant to prevent or punish such activity.
To operate, evaluate, debug, identify and repair errors, effectuate similar functional enhancements, and improve our Services and offerings.
To protect the legal rights, property, safety, and security of us, our users, our employees, and others.
To an actual or potential buyer, successor, or other organization in the event of an actual or potential merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, including as part of bankruptcy, liquidation, or similar proceedings.
To such other parties as you may expressly authorize when we collect the information or otherwise ask for your consent or authorization.
Your Choices
We provide you with choices with regard to the information we collect from and about you through the Services. For example, you may choose not to provide information we request through the Services. However, not providing information we request may restrict your ability to use certain features of the Services. For example, you may choose not to perform Wellness scans, or connect devices to the App, or integrate third-party applications with the App, but doing so will prevent you from receiving or using certain analytics, visualizations, and other reports through the Services that use information received from connected devices or third-party application integrations. Other examples of your Choices are described below.
You may be able to restrict the collection of certain information through the Website through your device's operating system or by disabling cookies, but doing so may prevent you from using the functionality of the Website. Some Internet browsers have a “do-not-track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, the Services do not respond to browser “do-not-track” signals, and other parties may collect information about your online activities over time and across different web sites when you use the Services.
You can access and correct, amend, or update your profile information by logging into the App and navigating to the “Profile” page.
You can request to delete your account by logging into the App, navigating to the “Profile” page, selecting your account, and selecting the “Delete Account” option. After you make an account deletion request, we will delete or otherwise render inaccessible information that identifies you personally from our systems. Once deleted, your data, including health, fitness, and wellness information, cannot be reinstated. Following your deletion of your account, it may take up to 30 days to delete your information and system logs from our systems. Your account deletion request will not affect, and we will continue to maintain and use, information that we maintain in a de-identified or anonymous form that does not identify and cannot reasonably be used to identify you. Additionally, we may retain information that identifies or can be linked to you notwithstanding your account deletion request when we determine that retention is necessary to comply with the law or to take other actions permitted by law.
We may send promotional and other push notifications to your mobile device through the App. You may deactivate these messages at any time by adjusting the notification settings on your mobile device.
You may opt out of receiving promotional emails from us at any time by following the opt-out link or other unsubscribe instructions provided in the email message.
If you would like to stop device location tracking, you may do so at any time by adjusting your device settings.
Third-party Links
The Services may include links to or options to integrate with third-party websites, applications, information, and services provided by third parties. We are not responsible for the privacy policies or practices of those third parties. We encourage you to review the applicable privacy policies of such third parties if you elect to follow the links provided or integrate our Services with third party applications and services.
Changes to this Policy
We may update this Policy to reflect changes in our privacy practices at any time and without prior notice to you. When we do so, we will update the Effective Date of the Policy, above. We encourage you to periodically review this Policy for the latest information on our privacy practices.
